EMCORE Corporation seeks a Manager, Export Compliance who will coordinate the company’s export licensing and compliance program. Responsibilities will include the development, execution (including training and auditing) and oversight of the company’s export compliance program.

ESSENTIAL DUTIES AND RESPONSIBILITIES:
• Develop and manage EMCORE’s export compliance program (including policies, procedures, checklists, etc.)
• Oversee compliance of export compliance program by all relevant employees, including IT and shipping departments, and provide guidance and assistance, as needed
• Provide expert advice and guidance concerning the requirements and obligations of export defense articles, technical data and defense services under the International Traffic and Arms Regulations (ITAR) and dual use items under the Export Administrations Regulations (EAR)
• Stay informed of current U.S. export regulations, procedures, laws, policies, etc.
• Support the senior leadership team in addressing export issues in existing programs and new business opportunities
• Determine and certify appropriate legal authority for exports or defense articles, technical data and defense services, in addition to dual use commodities/technologies
• Investigate any aspect of a proposed export or temporary export (e.g. information related to proposals, contracts, purchase orders, presentations and product development) to verify the legality of any transactions and the accuracy of the information to be submitted
• Prepare and administer any necessary license applications and agreements requiring U.S. Government approval for the export of technical data, hardware, services and coordination of potential imports as well as liaison with U.S. Government officials as necessary
• ITAR analysis (determination of classification), licensing (preparation, submission, implementation of approval) and compliance
o Form DTRADE licenses
o Form Technical Assistance Agreements
o Form Commodity Jurisdictions
o Form All other ITAR licensing matters as they occur
• EAR analysis (determination of obligations and classification of commodities), licensing (preparation, submission, implementation of approval) and compliance
• Implement the company export compliance manual including training in the procedures for ITAR and EAR, customs requirements, export/import documentation, license management and record keeping
• Maintain an Export and Import Control Database and Tracking system for management of licenses, agreements, correspondence and training
• Conduct and participate in internal export compliance audits on a periodic basis and manage any external regulatory agency compliance audits
• Investigate all matters of potential non-compliance, coordinate a report of finding with senior management and prepare voluntary disclosures, in coordination with outside advisors/counsel, as directed
• Direct corrective actions as necessary to follow compliance
Requirements MINIMUM EDUCATION:

BS degree, Engineering degree preferred



MINIMUM EXPERIENCE:

* 5 yrs. plus working with ITAR and EAR export licensing and compliance
* Expert knowledge in export/import regulations (ITAR, EAR and other), compliance, classifications, licensing and exemptions, Technical Assistance Agreements (TAAs), commodity jurisdiction requests and Technology Control Plans
* Strong writing, communication, training and research skills with attention to detail and the ability to work independently with general guidance and as a team player
* Must have a strong organizational skills coupled with, the ability to establish priorities among a wide array of projects
* Able to work with work with cross-funcational teams at all levels of the organization including, Engineering, HR, Operations etc.,
• Strong Microsoft Excel and Word skills – with Project a plus
• Working knowledge of ITAR and EAR export licensing and compliance is required for this role.

PREFERRED EXPERIENCE:
• Familiarity with other US export regulatory requirements a plus (OFAC, ANTIBOYCOTT, BATFE, FCPA)
